The high-stakes fallout surrounding Dr. Anthony Fauci’s contentious Senate testimony is intensifying following new details revealed by the committee’s chairman regarding potential legal actions.
Rather than letting a potential contempt resolution get bogged down in procedural delays across the full Senate floor, Sen. Rand Paul (R-KY) suggested a more direct mechanism to place the matter into the hands of federal prosecutors.
Speaking during a Fox News interview on Wednesday after a heated panel session, the Kentucky lawmaker explained that if the Senate Homeland Security and Governmental Affairs Committee votes to hold the former chief medical advisor in contempt, that finding could theoretically bypass typical legislative hurdles and head straight to the U.S. Department of Justice (DOJ).
Paul indicated he is confident the panel will approve the measure when it convenes next week.
“It’s actually a law. It’s a resolution,” Paul explained during the interview, emphasizing that the action formally requests federal prosecutors to evaluate contempt of Congress charges against the infectious disease expert.
Because the measure is structured as a congressional resolution rather than a standard piece of legislation, Paul argued that the usual path—requiring passage by both chambers and a presidential signature—may not apply.
“Since it’s not really a law, it doesn’t have an exact procedure. It doesn’t have a procedure where it goes to the president for signature. It doesn’t have to go to the House,” Paul noted, adding that committee approval alone might suffice to forward the evidence directly to federal law enforcement authorities.
This would not mark Paul’s first attempt to seek federal intervention regarding Fauci’s pandemic conduct. The senator recalled sending two prior criminal referrals during the Biden presidency, accusing the former official of making false statements to lawmakers and improperly destroying public records—both of which constitute federal felonies.
Paul further noted that he has submitted similar documentation and evidence to the Trump administration’s Justice Department on two separate occasions.
Wednesday’s confrontational hearing saw Fauci appear under subpoena to answer for federal management of the COVID-19 pandemic. Prior to questioning, Fauci delivered an opening statement alleging that committee Republicans were attempting to assemble a criminal prosecution rather than conduct impartial oversight.
On the advice of his legal counsel, Fauci repeatedly asserted his Fifth Amendment privilege against self-incrimination, declining to answer over 100 specific inquiries regarding NIH research grants, lockdown guidelines, virus origins, and vaccine mandates.
The session grew even more tense when Paul ordered the removal of one of Fauci’s attorneys, who attempted to speak without being officially recognized by the chairman.
Senate Democrats forcefully defended Fauci’s reliance on constitutional protections, arguing that persistent calls from Republicans for his imprisonment left him with no choice but to follow legal counsel. They charged that the majority had predetermined their findings long before the hearing began.
The hearing coincided with Paul’s public release of more than 1,100 pages of Fauci’s personal diary entries from the pandemic period, which Republicans claim reveal inconsistencies in the official narrative. Fauci has consistently denied any wrongdoing, maintaining that his personal logs align fully with his public testimony and official statements.
